Literary works are covered by copyright. The term ‘literary’ does not mean the work has to be of any special literary quality or standard;
it merely means recorded - or made material - in written, printed or digital
form. Literary works include fiction and non-fiction; journalism, scripts,
poetry and prose, to name but a few genres. We have described literary works
under the publishing sector, but please note that they do not need to be
published to come under the provisions of the Copyright Act. However, it
is only with publication and distribution of a literary work that most IP
debates come into play.
An overview of the guidelines for teachers
on using books, music and dramatic performance in schools is available from
the Publishers Association of South Africa (PASA
2003) and PiCC. Further information is available from the Dramatic, Artistic
and Literary Rights Organisation (DALRO).
